1. Parties & Scope

These Terms govern the relationship between you (user, agent, lawyer, buyer, seller, landlord, or tenant) and Kaastel (the “Company,” “we,” “us”).

This Website enables listing, browsing, and connecting with real estate agents, property lawyers, and property listings for sale, rent, or rent-to-own.

These Terms also define how brokers and agents operate under the brokerage framework facilitated through our India real estate property site.

2. Registration & Use of the Website

To use advanced features such as listing a property, messaging, or contacting agents and lawyers, users must create an account with accurate and up-to-date details.

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

You agree to use the Platform lawfully and not engage in any prohibited activities such as fraud, spam, or posting misleading property information.

3. Listings, Content & Accuracy

Agents, sellers, landlords, and legal professionals (“Contributors”) may list, buy, sell, and rent properties or offer legal services.

Contributors must ensure that all details about ownership, pricing, location, and condition are accurate and lawful.

Kaastel does not guarantee the authenticity of any listing or user. Verification of information and legal due diligence rests solely with the user.

The Company reserves the right to remove any content or listing that violates these Terms or applicable laws.

4. Brokerage Agreement & Commission

When an agent registers, the following voluntary commission terms apply:

• A ₹5,000 commission per successful transaction facilitated via the website.
• The broker or agent is not obligated to pay the said amount, and Kaastel has no right to demand payment. It is entirely on a voluntary basis.
• Payment, if made, is purely voluntary and due only after a completed transaction.

Both parties must maintain confidentiality regarding any property deal or client information.

Either party may terminate this arrangement by giving 30 days’ written notice.

This Agreement is governed by the laws of Kolkata jurisdiction, West Bengal, India.

5. Communications, Messaging & Document Exchange

The Platform includes secure tools for direct messaging, document sharing, and consultation scheduling.

Users must use these tools responsibly and refrain from sharing harmful, defamatory, or illegal content.

Kaastel may moderate communications to ensure compliance with Indian law and these Terms.

6. Intellectual Property

All material on this Website, including content, graphics, software, and design, is the intellectual property of Kaastel or its licensors.

Users may view and use this content solely for permitted purposes such as exploring rental properties for sale or buy-to-let houses.

Any reproduction, modification, or redistribution without written consent is prohibited.

7. Disclaimers & Limitation of Liability

The Platform is provided “as is” and “as available.” Kaastel does not guarantee uninterrupted access, accuracy, or successful completion of any deal.

The Company is not liable for losses, damages, or disputes arising from interactions or transactions between users.

To the maximum extent permitted by law, Kaastel’s liability is limited to any fees actually paid by the user (if applicable).

8. Termination / Suspension

Kaastel may suspend or terminate user access for violation of these Terms or any illegal or unethical behavior.

Upon termination, all rights to use the Platform cease immediately, but obligations such as confidentiality and governing law remain effective.

9. Amendments & Updates

Kaastel reserves the right to modify these Terms at any time. Updates will be posted with a new “Last Updated” date.

Continued use of the Platform after revisions indicates acceptance of the new Terms. Users are encouraged to review this page periodically.

10. Dispute Resolution & Governing Law

These Terms are governed by the Indian Penal Code, and any disputes fall under the exclusive jurisdiction of the Kolkata High Court.

Users agree to attempt amicable resolution before pursuing legal proceedings.

11. Miscellaneous

If any provision of these Terms is deemed invalid, the remaining sections will remain enforceable.
